World football&#8217;s governing body said third parties are not allowed to hold economic rights to players and the sanctions were upheld by CAS as well as the Swiss Supreme Court.<br \/>\nBut Seraing took the case to the Belgian courts to challenge the compatibility of FIFA&#8217;s rules with EU law. GETTY IMAGES<\/figcaption><\/figure>\n<\/div>\n<p>\u00abOn those grounds, the Court of Justice rules today that the national courts or tribunals must be empowered to carry out&#8230; an in-depth judicial review as to whether arbitral awards made by the Court of Arbitration for Sport are consistent with EU public policy.\u00bb The ruling brings into question the finality of CAS decisions when those decisions are based on arbitration clauses imposed by sporting bodies.<br \/>\nIn response to the judgement, the International Council of Arbitration for Sport (ICAS), which is responsible for the funding of CAS, said in a statement that the court handled cases from all over the world and therefore \u00abthe vast majority of cases before CAS concern contractual and disciplinary issues not governed by EU law\u00bb. Adem\u00e1s, podr\u00eda tener consecuencias de gran alcance para la FIFA, el organismo rector mundial del f\u00fatbol.<br \/>\nEl fallo se deriva de una sentencia del TAS contra el club belga Seraing, al que la FIFA prohibi\u00f3 inscribir nuevos jugadores y mult\u00f3 con cerca de 143.000 euros en 2015.<br \/>\nLa FIFA dictamin\u00f3 que el Seraing hab\u00eda infringido las normas al vender los derechos econ\u00f3micos de cuatro de sus jugadores al fondo malt\u00e9s Doyen Sports. El fallo pone en duda la firmeza de las decisiones del TAS cuando se basan en cl\u00e1usulas de arbitraje impuestas por organismos deportivos.<br \/>\nEn respuesta a la sentencia, el Consejo Internacional de Arbitraje Deportivo (CIAD), responsable de la financiaci\u00f3n del TAS, declar\u00f3 que el tribunal tramitaba casos de todo el mundo y, por lo tanto, \u00abla gran mayor\u00eda de los casos ante el TAS se refieren a cuestiones contractuales y disciplinarias no reguladas por el derecho de la UE\u00bb.
